The President of Iraq, Saddam Hussein , is a prisoner of war currently in the custody of US forces.

The US appears to have abrogated its obligations under the Geneva Convention, as indeed has the British Government, hence the endorsement of torture as @ Abu Graib, and the various torture flights carried out to secret CIA camps, using UK air space.

The so called "trial" of Saddam Hussein has been a farce throughout.

Human Rights Watch has criticised many aspects of the trial and the absence of due process.

The trial was instituted by the Coalition who themselves were and are in breach of international law by their decision to invade Iraq without due cause, and for the war crimes committed by the Coalition subsequently.

No legal forum established by the aggressors can be regarded as legitimate. (Nor can the current Iraqi regime, when the occupiers organised the elections, at the same time holding without trial many Iraqi nationals, thus preventing them from participating in the electoral process).

The Nuremberg Trials were conducted against a background of aggressive war, as instituted by the Nazis and this lent their proceedings legitimacy.

Of course we accept that all rulers are subject to the law, (including our own, who have escaped it for so long).

But those who advocate the death penalty against Saddam Hussein, such as the Rev Canon Andrew White, when there has been no effective trial of the accused, and when Saddam should have been treated as a prisoner of war, are themselves inciting murder, as that is what it will be should the sentence be implemented.

On prudential grounds it would seem to be the height of folly for the Americans to hand over Saddam for execution. The civil war in the country will be intensified and US-UK casualties increase.

An even deeper anger against UK and USA will take hold of the Arab world and many will seek to avenge the death of Saddam.

His children and grandchildren have already been murdered by the US.

What further purpose will be served by intensifying the conflict in this way?
