SNP Appeal

Appeal to the Scottish National Party

A coalition of UK peace groups asks the SNP to act as facilitator for a conference in Edinburgh, with a subsequent conference in London, to discuss International Justice in the context of examining war crimes as committed by the Western Alliance with particular reference to the Gaza crisis.

The Gaza War & the felonious response of the British Government and the BBC to this humanitarian disaster provided the germ for this idea.

Summary

The concept of an international legal order, where the only culprits ever arraigned consist in the leaders and operatives of those states defeated by the western alliance, while the western alliance itself is exempt from legal scrutiny, is unsustainable.


The question is whether

(a) it is possible or even desirable to seek for an international legal order, based on the precedents of Nuremberg, with individuals held accountable for crimes committed by them while in a military or executive office,

or

(b) if it is agreed that there shd be a legal order, is the currently flawed international legal order at all redeemable, &/or capable of being corrected?

By western alliance I have in mind the USA & such countries associated with, allied to, or under its influence, in terms of the USA significantly determining national policy.

In short

What concrete steps can be taken to put the focus on war crimes committed by the alliance?

And how can we overcome the blanket immunity from prosecution granted to western leaders?

We will examine the inadequacies of past UK enquiries, and possible future UK enquiry within the Parliamentary system, should such an ever be agreed, and discuss whether it is possible for such a future enquiry to significantly demonstrate executive culpability, given that Parliamentary enquiries and Royal Commissions in UK are controlled by the executive.

We believe the UK executive will go to any lengths, in terms of bribing, threatening and even murdering individuals in order to obfuscate and cover up the truth as indicated by the death of Dr David Kelly.

We will ask why impeachment proceedings have not been instituted against the UK war leaders in Parliament, and as Westminster is so unwilling to examine the malfeasance of the Cabinet, we question if there is a route via the Scottish Parliament and the Welsh and NI assemblies?


We may conclude that only the legal route is possible, i.e. western leaders shd be held accountable before either international courts or domestic courts, or both, (subject to such courts functioning according to universally accepted legal criteria )


We will look at various military adventures of the alliance since May 1st 1997 to the present day concentrating on the Gaza campaign, perceived as a reprisal on innocent civilians, where Israel did the actual killing, while the alliance acted as the captors of the civilian population, in effect lining the women and children up against the wall, so they could be shot.

We will examine the law of genocide and see if there are any steps that can be taken to save a nation from gradual and painful obliteration.

We want to arrive at, and ratify a Strategy for Palestine, in the context of examining the roots of the Arab Israeli conflict, suggesting the unworkability of the two state solution, as Arabs will not be put into Bantustans, &the need to escalate political pressure on the Israeli Government to desist from war crimes by imposing sanctions on trade, finance and relations.

We want to examine how diplomatic pressure on the UN General Assembly and Security Council can be applied with a view to setting up an International War Crimes Tribunal for Palestine.

Peaceful resolution of a conflict by legal redress could defuse the state of alert over terrorism, as so many contemporary terrorist threats incorporate references to the cruel and terrifying destruction of Palestine.

The objects of the conference will inter alia involve formulating a counter strategy to international terrorism, bearing in mind that most terrorism of the present day is state terrorism as applied by the western alliance.


The aim would be to prepare over the next two months with a view to holding the Conference in June, first at Holyrood House and then at a later date in the Palace of Westminster.

Israeli Massacre of Gaza
The Israeli Massacre of Gaza which they tried to stop the world from seeing was a conspiracy to murder a group of people. The indiscriminate mass murder and maiming of a whole population is not only a disgraceful series of War Crimes and Crimes Against Humanity. The deliberate destruction of an ethnic, religious or national group, in whole or in part, is defined by the Geneva Conventions as 'Genocide' more succinctly defined in the International Criminal Court Act (2001) p69.
Drastic action is needed before these despicable crimes are repeated.
It is the worst example of cruel inhumanity the world has yet seen: Worse than the holocaust, where fighter bombers were not used on civilians and which was over in 5 years;
Worse than Iraq where at least people were not so caged in;
Worse than Zimbabwe, Rwanda or Apartheid South Africa where again there was no carpet bombing with chemical weapons;
Far worse than Georgia;
Far worse than Guantanamo Bay;
Immeasurably worse than Tiananmen Square.
The Zionist regime must be arraigned. It should be dismantled and buried. Stalin gave Jews a homeland in 1928 in Birobidjan, East Russia where 200,000 live in peace.
The most civilized way to end this serial Genocide, because Israel is clearly deaf to persuasion, is for every conscientious government to start immediate proceedings against Olmert, Livni, Barak, Netanyahu et al. in national courts under the Geneva Conventions, which oblige States Party to take action when such crimes are committed, whether the criminal state has signed up or not. The felons can be arrested when they land, as Daniel Machover has pioneered.
Of course, the UN Security Council should resolve to refer the massacre to the International Court of Justice and apply immediate restrictions on suspects' movement as well as their trade, finance and an armament, under Chapter V11 of the Charter which invokes the threat of military blockade if all else fails. Art.27 of the Charter provides for dismissing Parties to the dispute such as the USA.
If this is frustrated by Zionist blackmail, the General Assembly can set up an International War Crimes Tribunal on Israel under Article 22, as outlined by Prof Francis Boyle of Illinois University Law School.
